Being eligible for a record suspension depends on the length of time since your last offence. Criminal offences in Canada are either summary or indictable. Summary offences are minor offences and carry a wait period of 3 years from the completion of your sentence, not including prohibitions of driver’s licences or possession of firearms. Indictable offences are more serious offences and carry a wait period of 5 years from the completion of your sentence, not including prohibitions of driver’s licences or possession of firearms. A few extremely serious offences carry a wait period of 10 years.
