If you have never been convicted of a crime, you cannot receive a Pardon in Canada. So what do you do if a non-conviction record is holding you back from enjoying life? A Record Purge is useful for ridding your past of these non-conviction records.

Each courthouse and police department maintains separate records for everyone that passes through their system. Even if you have never been convicted of a crime, a registered background check can still show non-conviction records.

Left alone, these records could impede your ability to find work, adopt a child, or even travel freely across the border.

Record Purge – Eligibility

To be considered personally eligible for a Record Purge:

  • You must not be convicted of a summary or indictable offense.
  • You must not have a criminal case pending before the courts.
  • In the case of a discharge, your record must originate before July 24, 1992.

There are no waiting periods required to apply for a Record Purge, you may apply for a record destruction immediately after an arrest, or after appearing in court.

However, because local police have a say in the success of a file purge and file destruction, a current investigation or ongoing suspected criminal activity would pose a significant obstacle to a record removal process.

You must not have a criminal case pending before the courts. This includes courts in other jurisdictions.

Express Pardons Canada completes a Canada-wide search for criminal record information before proceeding with the record destruction. If a conviction record is found, Express Pardons Canada will contact you to suggest a change in your service.

Any withdrawn charges, stays of proceedings, or acquittal records are eligible for a record removal.

For conditional or absolute discharges, only records created before July 24, 1992 are eligible for a record removal.

Discharges that occurred after July 24, 1992 are automatically removed.

Record Purge - What You Can Expect

It Takes Time To Do Things Right:

The process for completing a Record Purge can take 6 months to a full year to complete. Express Pardons has built a reputation for success, but we only got to here by taking the time to do our homework. Because Record Purges are done at the local level, it is important to know first where the records are, and then to build your case for having them removed.

Expecting the Unexpected:

A Record Purge is conducted at the local level. This means that Express Pardons must treat with each court and police centre that you came into contact with. Third party charges for filing or access to information may come up, but Express Pardons will keep you aware at all times of your obligations during this process.

The Upside:

If you received an Absolute Discharge on or after the date of July 24, 1992, your record will be automatically purged from the system 1 year after the date of your sentence.

If you received a Conditional Discharge on or after the date of July 24, 1992, your record will be automatically purged from the system 3 years after the date of your sentence.

Of course, if your records originated before July 24, 1992, then Express Pardons is here to assist you in effectively purging them.

All physical paper records involved in this process are secured according to the Royal Canadian Mounted Police (RCMP) accreditation standards.

How Safe is My Online Data?

All personal information collected on our site is secured and transmitted with full 128-bit Secure Sockets Layer (SSL) encryption. Payment information is processed with 128-bit encryption using the same secured session keys required by today’s online banking standards.

Who Else Sees My Information?

Express Pardons will never contact or communicate with anyone other than you, or the relevant third parties involved in the application requested, as required.

Documents containing personal information are mailed in unmarked envelopes to protect your identity.

For How Long is My Information Kept?

Upon the completion of service, Express Pardons will retain non-payment related personal information for up to 60 days, after which time this information is physically destroyed. All payment related information is kept for up to 5 years, as is the legal requirement of the Canada Revenue Agency.
