Pardon Application Process

How To Receive A Criminal Pardon In Canada

Criminal records are divided into two categories: Summary convictions, and Indictable convictions. Summary offences (or cases tried “summarily”) are for minor offences and are the most common type of offence in Canada. Indictable offences (or cases tried by “indictment”) are for more serious offences and require additional work.

If you’re not sure whether your conviction was tried summarily or by Indictment, see Pardon Eligibility (link to /pardon-eligibility/) for a list of common offences.

Express Pardons Canada puts their two-decades of experience helping thousands of Canadians get the second chance they deserve to work to build a case representing you to the Pardons and Clemency board at the Parole Board of Canada. The support documents required include:

  • Pardon Claim Form
  • Authorization Waiver(s)
  • Fingerprints
  • Copies of Identification
  • Certified Criminal Records
  • Court Documents
  • Police Reports
  • Military Conduct Reports
  • Urgency Documentation
  • Proof Of Convictions
  • Proof Of Canadian Status
  • Board Filing Fee

In this phase of the pardon process, Express Pardons Canada perform three crucial functions:

  1. Demonstrate your legal eligibility to receive a pardon in Canada.
  2. Demonstrate your good citizenship to remove your criminal record.
  3. Make the case for special status to the National Parole Board.

But Express Pardons Canada’s work doesn’t end there. They work with the Pardon and Clemency board of the National Parole Board as they screen, assign and validate your claim to ensure our guarantee of success.

How Does The Summary Pardon Process Differ From The Indictable Pardon Process?

Indictable offences also require some additional work to convince the National Parole Board (also known as the Parole Board of Canada) to grant your pardon.

In addition to the pardon process listed above, Express Pardons Canada must demonstrate on your behalf:

  • What changes a pardon would bring to your life.
  • What positive changes you have already made to improve your situation since receiving your criminal record.
  • Why your offences were committed and how you received your criminal record.

For indictable pardon cases, Express Pardons Canada will:

  • Assign certain aspects of the file to more senior, criminal record experts and paralegal advisors.
  • Develop a strategy to convince the National Parole Board that a pardon is warranted and deserved.
  • Guide you through the additional support documents required.
  • Demonstrate to the National Parole Board that the pardon will support rehabilitation, and not bring the administration of justice into disrepute.

PLEASE NOTE: Due to the additional work required in clearing a criminal record charged by Indictment, these files are subject to an additional $150 fee charged on receipt of a certified Indictable criminal record. Further, as with all Legal and Pardon Services, certain documentation requires payments to be made on your behalf by your Legal representation and you may be required to pay for these disbursements separately approximately 6 months into the process. We provide a statement breaking down the disbursements incurred on your behalf during the process.
