Introduction

Welcome to the Internet site of Express Pardons (“EXPRESS PARDONS”). These Terms and Conditions apply to this EXPRESS PARDONS Website. By using this EXPRESS PARDONS Site, or any of the Pardon or U.S. Entry Waiver products available on this EXPRESS PARDONS site, you agree, without limitation or qualification, to be bound by these terms and conditions and such other additional or alternative terms, conditions, rules and policies which are displayed in connection with any particular EXPRESS PARDONS site or product, all as may be modified by EXPRESS PARDONS from time to time in its sole discretion (collectively the “Terms and Conditions”). If you do not agree with these Terms and Conditions, you may not use this EXPRESS PARDONS site or purchase any of the services on this EXPRESS PARDONS Site.

Please note that we reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time. Please check periodically for changes. Your continued use of this EXPRESS PARDONS site following the posting of any changes to these Terms and Conditions will mean you accept those changes.

Express Pardons Site and Product Policies

EXPRESS PARDONS helps its customers make applications for Canadian pardons, U.S. entry waivers (I-192), non-conviction record purges, and criminal record searches by carefully preparing the necessary documents, conducting inquiries, and acquiring supporting documents to prepare petitions to the appropriate government agencies to obtain a pardon, U.S. entry waiver, confirmation of file destruction, or to acquire copies of criminal information.

We do not provide legal advice. Should you require legal assistance, please consult a lawyer.

EXPRESS PARDONS guarantees our best efforts in accurately preparing the necessary documents for the customer. No pardon service company can guarantee the ultimate success of a pardon, entry waiver, record purge or criminal record search. The accuracy of any documents prepared by EXPRESS PARDONS depends on the information provided by the customer during the application process. EXPRESS PARDONS will not be held liable for the failure of any application made on the customer’s behalf, under any circumstances.

Express Pardons Inc. guarantees our best efforts in accurately preparing the necessary documents for the customer. No pardon service company can guarantee the ultimate success of a pardon, entry waiver, record purge or criminal record search. The accuracy of any documents prepared by Express Pardons Inc. depends on the information provided by the customer during the application process. Express Pardons Inc. will not be held liable for the failure of any application made on the customer’s behalf, under any circumstances.

Express Pardons Inc. offers a guaranteed service of our “Standard Pardon Application” (summary convictions only) if we are unsuccessful in obtaining your pardon, we will complete a second application free of charge, except under the following circumstances:

You are found, during the application process, to have been involved in any undisclosed criminal activities or police intervention(s) within the last five years.
You elect to terminate the application process for any reason, including refusal to pay disbursement fees. Express Pardons must be allowed to honor our guarantee to deliver your pardon.
You do not maintain a valid mailing address with Express Pardons Inc. for 6 months or more, and Express Pardons Inc. is unsuccessful in contacting you after three separate attempts. An inactive file will be closed at the discretion of Express Pardons. A reactivation fee of $150 per application applies when reopening a closed file.
Your contact with Express Pardons Inc. staff is abusive and/or inappropriate and results in the termination of your service(s).
Force Majeure – An act of war, strike, riot, crime or of parliament prevents Express Pardons from completing its obligations.

Should this second free “Standard Pardon Application” be unsuccessful, You will be refunded your service fee less disbursements paid on your behalf to other agencies.

Our services are considered complete, and any remaining payment is due when we have submitted your application(s) to the appropriate government agencies.

Your confidentiality is guaranteed. All of your information is used exclusively for the execution of services requested and will never be sold or rented to other interests. See Privacy Policy for more detail.

By completing an on-line or telephone application you authorize EXPRESS PARDONS to start working on your behalf. The fees for our services become due immediately. Express Pardons Inc. will not begin substantial work on services until an agreed upon first payment has been successfully processed.

Due to the work involved with processing applications with indictable offences, these clients are subject to an additional $150 surcharge.

EXPRESS PARDONS endeavors to prepare the required service documents within 72 hours of the time of application. The delivery times for services documents are dependent on Canada Post delivery and are not guaranteed. In the event an application package is not received within 12 business days of completion, EXPRESS PARDONS may, at its sole discretion, produce a new package at no additional cost. In the event a package of service documents fails to reach a customer due to incorrect/incomplete mailing information provided by the applicant at the time of application, an additional fee of $75.00 applies to any replacement package produced. Under no circumstance will EXPRESS PARDONS consider a request to reproduce any documents once 60 days have elapses since the time of application, without payment of an additional fee of $75.00 to cover the administrative costs of producing the documents.

Notwithstanding our Pardon Guarantee, due to the unique and non-recoverable nature of our services, once Express Pardons Inc. has received any form of payment, all fees paid to Express Pardons Inc. are non-refundable.

Disbursements: I understand that Express Pardons Inc. undertakes certain expenditure on my behalf to complete my application, including but not limited to: Police checks, and relevant court documents. By accepting these terms and conditions I hereby authorize Express Pardons Inc. to undertake these expenses on my behalf and further authorize Express Pardons Inc to charge the credit card on file for said disbursements. The client is further aware that this Disbursement process takes place approximately 4 – 6 months from the commencement of service. I understand that these fees are external to Express Pardons and are subject to change during the application process and have been undertaken and paid on my behalf. Any scheduled payment that is declined on a credit card or that is returned as a non-sufficient funds cheque will incur a $20 fee.

EXPRESS PARDONS will not begin work on services until an agreed first payment has been successfully processed.

EXPRESS PARDONS reserves the right to reject any application.

Disclaimer

YOU EXPRESSLY UNDERSTAND AND AGREE THAT IN NO EVENT SHALL EXPRESS PARDONS INC., INCLUDING ITS AFFILIATES AND LICENSORS, BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, AND ANY DAMAGES FOR LOSS OF PROFITS, SAVINGS, GOODWILL OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER EXPRESS PARDONS INC. HAD BEEN ADVISED OF OR COULD HAVE FORESEEN THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH: (A) THE USE, INABILITY TO USE OR PERFORMANCE OF ANY OF THE SERVICES OR (B) ANY UNAUTHORIZED ACCESS TO OR MODIFICATION TO ANY OF YOUR PERSONAL DATA OR TRANSMISSIONS, OR (C) ANY OTHER MATTER RELATING TO THE EXPRESS PARDONS INC. WEBSITE OR ANY OF THE SERVICES PROVIDED BY EXPRESS PARDONS.

Restrictions on Use of Materials

All material, information and content (collectively “Content”) available on this EXPRESS PARDONS Site, including the manner in which such Content is presented, and the services are: the sole property of EXPRESS PARDONS, its registrars, affiliates and/or licensors. All rights reserved. Such Content is protected by Canadian and worldwide laws and treaty provisions. Except as provided herein, you agree not to reproduce, make derivative works of, retransmit, distribute, sell, publish, communicate, broadcast or otherwise make available any of the Content obtained through this EXPRESS PARDONS Site or any of the services, including without limitation, by caching, framing or similar means, without the prior written consent of the respective owner of such Content. EXPRESS PARDONS grants you a limited non-exclusive, non-transferable license to use and display on your computer or other electronic access device, the Content and services for your own personal and non-commercial use only, provided that you do not modify the Content and that you maintain all proprietary notices.

EXPRESS PARDONS reserves the right, in its sole discretion, to add to, remove, modify or otherwise change any part of these Terms and Conditions, in whole or in part, at any time. Except as otherwise expressly contemplated herein, changes will be effective when notice of such change is posted on this EXPRESS PARDONS Site. If any change is not acceptable to you, you must discontinue your use of this EXPRESS PARDONS site or any of the services immediately. Your continued use of this EXPRESS PARDONS site or any of the services after any such changes are posted will constitute acceptance of those changes. Further, EXPRESS PARDONS reserves the right to change, modify, suspend or discontinue any aspect of this EXPRESS PARDONS site or any of the services, or Content from time to time without notice or liability and for any reason whatsoever.

Indemnification

You agree to defend, indemnify and hold harmless each of EXPRESS PARDONS, its affiliates and licensors and each of their respective officers, directors, employees and agents, including all third parties mentioned on this EXPRESS PARDONS site, from and against any and all claims, actions or demands, including without limitation legal and accounting fees, resulting from or related to: (a) your breach of any of these Terms and Conditions; (b) your access to or use of this EXPRESS PARDONS site, EXPRESS PARDONS services, or Content; or (c) your use or reliance on, or publication, communication or distribution of anything on or from this EXPRESS PARDONS site or through any of the Pardon or U.S. Entry Waiver Products contain therein. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT IN NO EVENT SHALL EXPRESS PARDONS, INCLUDING ITS AFFILIATES AND LICENSORS, BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, AND ANY DAMAGES FOR LOSS OF PROFITS, SAVINGS, GOODWILL OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER EXPRESS PARDONS HAD BEEN ADVISED OF OR COULD HAVE FORESEEN THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH: (A) THE USE, INABILITY TO USE OR PERFORMANCE OF ANY OF THE PRODUCTS ON THIS EXPRESS PARDONS SITE, OR (B) ANY UNAUTHORIZED ACCESS TO OR MODIFICATION TO ANY OF YOUR CONTENT OR TRANSMISSIONS, OR (C) ANY OTHER MATTER RELATING TO THIS EXPRESS PARDONS SITE OR ANY OF THE PARDON OR U.S. ENTRY WAIVER PRODUCTS

You expressly acknowledge that EXPRESS PARDONS has entered into this agreement, and has and will make this EXPRESS PARDONS site, Content and Pardon and U.S. Entry Waiver Products available to you in reliance upon the limitations and exclusions of liability and the disclaimers set forth herein, and that the same form an essential basis of the agreement between you and EXPRESS PARDONS. You expressly agree that the limitations and exclusions of liability and the disclaimers set forth herein will survive, and continue to apply in the case of, a fundamental breach or breaches, the failure of essential purpose of contract, the failure of any exclusive remedy or termination of this agreement.

Termination

You acknowledge and agree that EXPRESS PARDONS, in its sole and absolute discretion, may, without notice to you, suspend or terminate your use of, or access to, this EXPRESS PARDONS site, Content and the EXPRESS PARDONS services contained therein. If you are dissatisfied with this EXPRESS PARDONS site or any of the Services or with any terms, conditions, rules, policies, guidelines, or practices of EXPRESS PARDONS in operating this EXPRESS PARDONS site or any the Pardon and U.S. Entry Waiver Products, your sole and exclusive remedy is to discontinue using this EXPRESS PARDONS site or any of the EXPRESS PARDON services.

General Provisions

This agreement is personal to you, and you may not assign your rights or obligations to anyone. These Terms and Conditions constitute the entire agreement between EXPRESS PARDONS and you pertaining to your use of this EXPRESS PARDONS site, any of the Pardon and U.S. Entry Waiver Products, and Content and supersedes any prior agreements between you and EXPRESS PARDONS with respect to the subject matter hereof. EXPRESS PARDONS failure to insist upon or enforce strict performance of any right or provision of these Terms and Conditions shall not constitute or be construed as a waiver of any right or provision. If any of the provisions (or parts thereof) contained in these Terms and Conditions are determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions (or parts thereof) contained herein. No changes to these Terms and Conditions shall be made except by a revised posting on this page or except as otherwise expressly contemplated herein. The parties have required that these Terms and Conditions and all documents relating thereto be drawn up in English.
